2. Service Description

Mindfull provides tools for mood tracking, journaling, accessing mindfulness exercises, and interacting with an AI assistant for supportive reflection. The Service is intended for personal, non-commercial use to support general mental well-being.

Important Disclaimer: Mindfull is not a substitute for professional medical advice, diagnosis, or treatment. The AI assistant does not provide therapy or medical services. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical or mental health condition. Never disregard professional medical advice or delay in seeking it because of something you have read or experienced on the Service.

3. User Accounts

To use certain features, you may need to create an account using your email address. You are responsible for maintaining the confidentiality of your login credentials (e.g., verification codes sent to your email) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of the content you create within the Service, such as journal entries and mood notes ("User Content"). By using the Service, you grant Mindfull a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of operating, providing, and improving the Service, including training our AI models (subject to the terms in our Privacy Policy regarding anonymization and aggregation where applicable).

You are solely responsible for your User Content and agree not to submit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

5. AI Features

The AI features within Mindfull are designed to provide supportive reflections and insights based on the information you provide. Responses generated by the AI are informational and should not be considered definitive or a replacement for human judgment or professional advice. Interactions with the AI are subject to the data usage policies outlined in our Privacy Policy.

6. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Infringe upon the rights of others.
• Transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to the Service or other user accounts.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE“ basis. Mindfull makes no warranties, expressed or implied, regarding the Service, including but not limited to its accuracy, reliability, or suitability for any particular purpose. To the fullest extent permitted by law, Mindfull shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
